Article 15. Warranties

The customer benefits from the legal warranty of conformity as well as the warranty against hidden defects in accordance with the applicable legal provisions.

15.1 Legal Warranty of Conformity

The legal warranty of conformity covers all conformity defects existing at the time of delivery of the product. Customers have 2 years after delivery or purchase of the goods to invoke the warranty. This procedure is free of charge. If you use the legal warranty of conformity to have your product repaired, you benefit from a six-month extension of this warranty. Thus, on a repaired item, the legal warranty of conformity is extended from 24 to 30 months.

The defect is automatically considered to have existed before the purchase of the product. Therefore, the customer does not have to provide proof of the date of occurrence of the defect. However, the legal warranty of conformity applies provided that the defects alleged are reported to uhomedesign.com as soon as they appear. The customer must also provide evidence of the existence of the defects, such as by sending photographs, videos, or any other means of proof of the problems encountered.

If the defect becomes apparent after a period of 2 years from delivery, the presumption no longer exists, and it is the customer who must prove not only the reality of the defect but also that this defect existed before the delivery of the product.

The customer has the choice between repairing and replacing the goods. In case of an obvious difference in cost between the two options, U HOME DESIGN may impose the cheaper option. For example, if shipping replacement parts is less expensive than sending a new piece of furniture, uhomedesign.com may impose shipping replacement parts. Repair or replacement of defective products is at no cost to the customer.

The customer can be fully or partially refunded only in three cases:

- If repair is impossible (for example, if production has been discontinued).

- If repair or replacement cannot be carried out within one month following the customer's claim.

- If repair or replacement causes major inconvenience to the customer.

15.1.1 Defects Covered by the Legal Warranty of Conformity:

- Goods unsuitable for the usual use expected of goods of the same kind.

- Goods that do not correspond to the description given by uhomedesign.com even if they function perfectly.

- Goods that do not have the qualities advertised by uhomedesign.com or agreed upon with them.

- Goods that have a manufacturing defect, imperfection, or poor assembly.

- Incomplete or incomprehensible installation manual preventing customers from assembling the products properly.

15.1.2 Cases where the Legal Warranty of Conformity Does Not Apply:

- The customer was aware of the defect at the time of purchase.

- The customer could not have been unaware of the defect at the time of purchase.

- The defect results from materials provided or added by the customer.

- The customer makes a claim more than two years after purchase or delivery.

- For self-assembly furniture or kit furniture, the warranty applies to each element of the furniture, taken separately; it does not apply to the furniture once assembled unless the defect arises from the assembly instructions.

15.1.3 Conditions for Activating the Warranty:

- Our technical service confirms that the product is in conformity with the product sent to you, without damage, modification, or intervention of any kind.

- The defect claimed by the customer does not result from:

   - Abnormal or non-compliant use.

   - Wear or normal aging.

   - An accidental event or, more generally, an external cause (such as the intervention of any unauthorized third party on the product or a defect related to abnormal or non-compliant use of your product).

Damages Excluded from the Warranty:

- Damages resulting from causes external to the product.

- Damages resulting from non-compliance with assembly instructions or installation not in accordance with the manufacturer's instructions, from poor quality of the device's power supply (defective electrical voltage, voltage error, non-compliant gas, drainage, high water pressure, filter cleaning...), from lack of ventilation (clogging of ventilation openings or insufficient space for ventilation), from lack of maintenance.

- Elements or accessories that require regular replacement (batteries, filters, lamps, etc.).

- Damages occurring during transportation or relocation of the product carried out by the customer or a third party under their responsibility.

15.2 Warranty for Hidden Defects

uhomedesign.com is liable for hidden defects in the products sold that make them unsuitable for the use for which they are intended or that so diminish this use that the buyer would not have acquired them or would have paid a lower price if they had known about them. The action resulting from hidden defects must be brought by the buyer within a period of two years from the discovery of the defect. If the customer provides proof of the existence of a hidden defect, they may choose between canceling the sale or reducing its price.

15.3 Commercial Warranties

Commercial warranties may be offered for certain products. They are optional and do not replace legal warranties. Therefore, commercial warranties may vary (duration, scope, etc.) depending on the products, suppliers, and brands.
